The pump starts whining on a cold morning, or the belt lets go on the highway, and suddenly the steering wheel that used to turn with two fingers now takes both arms and your whole back. Some drivers push through it for weeks because the car still technically moves and steers. Is it actually illegal to drive without power steering?

It depends on how the car left the factory. Driving a vehicle designed without power steering is fully legal. But driving a factory-equipped vehicle with a broken, leaking, or disabled system is illegal in nearly every U.S. jurisdiction.

That one-sentence answer covers two entirely different legal categories, and the gap between them is the whole story. A pre-power-steering classic or a purpose-built manual-rack sports car was engineered around a high steering ratio that keeps effort manageable without assist — nothing about that violates any federal or state rule. A modern car built with power steering, on the other hand, was engineered around a low steering ratio that assumes the assist is always working. Why a Failed Power Steering System Isn't Just Heavier — It's a Different Car

A steering system's steering ratio — the number of degrees the steering wheel must turn to pivot the road wheels one degree — is the variable that determines everything else.[1] Engineers building a traditional manual rack use a high ratio, which trades more steering wheel turns for a strong mechanical advantage, keeping the effort a driver needs to overcome tire friction and the vehicle's self-aligning torque within a manageable 4 to 11 newton-meters at a standstill.[2]

Power steering exists to let engineers do the opposite: lower the ratio so the car responds to small wheel inputs, then use an external force to make up the mechanical advantage that lower ratio gives away.[1] A hydraulic system (HPS) does this with an engine-driven pump pressurizing fluid to roughly 1,200-2,682 psi; when the driver turns the wheel, a torsion bar in the column twists slightly, redirecting that pressurized fluid into a cylinder that pushes the rack.[1] An electric system (EPS) reads that same torsion-bar twist electronically and commands a motor to apply the assist instead of routing fluid.

When that assist disappears — a snapped belt, a ruptured line, a dead EPS module — a federally required mechanical fail-safe keeps the wheel physically connected to the road wheels, so the car does not become unsteerable.[1] What changes is the effort. The driver is now turning a low-ratio rack with no assistance at all, and in a hydraulic system, also pushing stagnant fluid through the rack's internal valves — a phenomenon that creates its own resistance on top of the mechanical disadvantage.[2] SAE-parameter testing shows that spike in required force can exceed what many drivers can generate at low speed, which is exactly when a parking-lot maneuver or a sudden obstacle demands the most precise control.[2]

Some owners try to work around a leaking hydraulic rack by “looping the lines” — connecting the inlet directly to the outlet to trap fluid inside the system. Engineering consensus treats this as unsafe: a looped rack still forces the driver to push fluid through the internal seals without pump pressure behind it, producing steering that is heavier and less predictable than a rack genuinely designed for manual operation from the start.

What Federal Manufacturing Standards Actually Require

The National Highway Traffic Safety Administration (NHTSA) regulates new-vehicle manufacturing through the Federal Motor Vehicle Safety Standards (FMVSS), but no FMVSS mandates that every passenger car ship with power steering. The standards regulate performance and crashworthiness outcomes, not specific components — FMVSS 204 limits how far the steering column can move rearward into the cabin during a frontal crash, for example, regardless of whether the rack behind it is manual or assisted.

That performance-based design leaves automakers technically free to sell a manual-steering car, provided it meets every dynamic-handling and crash-safety metric. In practice, rising curb weights and consumer demand for low-effort maneuverability have made power assist a practical necessity on nearly every modern vehicle heavier than a lightweight sports car — which is exactly why the legal exposure below almost never applies to the manual-rack originals still on the road, and almost always applies to a modern car's broken assist system.

Commercial Trucks: 49 CFR § 393.209 Leaves No Ambiguity

For commercial motor vehicles, the analysis skips the “it depends” entirely. The Federal Motor Carrier Safety Administration (FMCSA) enforces 49 CFR § 393.209, which requires every steering component — the wheel mount, the column, universal and ball-and-socket joints — to be free of excessive wear, with no welded repairs permitted.[3] Subsection (e) addresses power steering specifically: belts must not be frayed, cracked, or slipping; the system must not leak; and the fluid reservoir must be adequately filled.[3]

The regulation also sets numeric tolerances for steering wheel lash— the amount of free play a driver can turn the wheel before the road wheels actually begin to pivot. Excessive lash signals a worn steering gear box, a loose pitman arm, or degraded tie-rod ends, and it directly erodes a driver's ability to hold a lane or react to an emergency.[3] The allowable lash scales with the steering wheel's diameter and whether the truck uses manual or power steering — power-assisted systems are allowed more play than manual ones, because the assist itself takes up some of the slack.

Out-of-Service: A Truck That Can't Legally Move

Enforcement runs through roadside inspections guided by the Commercial Vehicle Safety Alliance (CVSA) North American Standard Out-of-Service Criteria.[4] An inspector who finds a power steering leak dripping onto moving parts, missing steering fasteners, or lash beyond the federal table issues an immediate Out-of-Service order — the truck is legally immobilized on-site until a mobile mechanic repairs the defect or the vehicle is towed to a shop.[4] Rules tighten further for vehicles carrying vulnerable passengers: under FMCSA 49 CFR § 396.11, a school bus must be placed out of service if power steering play exceeds 10 degrees.[5]

Passenger Vehicles: “Unsafe Vehicle” Statutes Fill the Gap

Passenger cars aren't governed by the FMCSR — but every state carries some version of an “unsafe vehicle” statute, and those statutes are broad enough to reach a failed power steering system without naming it specifically.

California Vehicle Code § 24002 makes it unlawful to operate any vehicle that is in an unsafe condition or not equipped as required by law.[6] The statute does not have to mention a power steering pump; because a failed system drastically increases steering effort and compromises a driver's ability to execute an evasive maneuver, a stop for erratic lane drifting traced to a dead power steering rack falls squarely inside it.[6]

Texas Transportation Code § 547.004 classifies operating an unsafe vehicle as a misdemeanor and holds an owner accountable for knowingly permitting a dangerously degraded vehicle on public roads.[7] New York enforces the same underlying principle indirectly: a power steering failure that causes a loss of control resulting in property damage can draw an unsafe-lane-change citation under VTL § 1128 or a failure-to-exercise-due-care citation under VTL § 1146, and continuing to drive a vehicle that has already failed a safety inspection for a mechanical defect risks fines and impoundment under VTL § 301.

What Happens in Court After a Steering Failure Causes a Crash

Beyond citations and failed inspections, the largest financial exposure sits in civil tort law. Every driver owes a duty of reasonable care that includes keeping their vehicle in safe operating condition. A driver who knows their power steering is leaking, whining abnormally, or throwing an EPS warning light — and keeps driving anyway — is breaching that duty.

In many jurisdictions, that breach triggers negligence per se: a driver who violates a safety statute (an unsafe-vehicle law, or the FMCSR's maintenance requirements for a commercial truck) and causes the exact type of harm the statute exists to prevent has effectively proven both duty and breach through the violation alone. In the Georgia Court of Appeals case Almassud v. Mezquital, a driver whose vehicle allegedly became uncontrollable when its steering suddenly failed was tied to a collision that produced a $30 million jury verdict — illustrating how large the financial exposure becomes once a steering-related crash reaches a jury.[12]

Software failures produce the same result through a different mechanism.
