Is It Illegal to Leave Your Car Running While Pumping Gas?

A hot cabin, a sleeping passenger, or a two-minute stop can make leaving the engine on feel harmless. But the warning printed on the pump is not merely station etiquette: as fuel fills an open tank, the vapor it displaces vents into the air right at the nozzle. Is it illegal to leave your car running while pumping gas?

Usually: the fire code in force at a retail fuel dispenser commonly requires the engine off while fuel is dispensed. The exact enforcement rule comes from state or local fire code; federal rules separately require the same practice for commercial vehicles and workplace equipment.[1]

There is no single federal traffic offense written for the ordinary driver at the pump — the fire code adopted where you are fueling supplies the rule. The sections below cover where that rule comes from, the safety reasoning behind it, and what a check-engine light after refueling does and does not prove.

Where the engine-off rule comes from

The rule at a typical pump concerns fire safety, not whether the car is moving. Section 2305.4 of the International Fire Code says the engines of vehicles being fueled must be shut off. The IFC is a model code, not federal law; it becomes enforceable only where a state or local government adopts it or an equivalent rule.[2]

Ohio shows the statutory chain clearly. Ohio Revised Code § 3741.14 makes self-service stations operate under NFPA 30A as incorporated into the state fire code, and requires each self-service pump island to post “STOP ENGINE.”[1] Oregon's State Fire Marshal rules likewise require the sign “Vehicle engines must be shut off while fueling”; the rule authorizes civil penalties of up to $500 for each facility violation.[3]

Passenger cars

The controlling requirement is normally the adopted state or local fire code at the dispensing facility.

Workplaces

OSHA requires forklift fuel tanks not be filled while the engine is running.

Commercial vehicles

49 CFR § 392.50 prohibits fueling a CMV with the engine running, subject to a narrow necessity exception.

Who can be cited, what the penalty is, and which code edition applies all vary by jurisdiction. Facility rules often place duties on the owner or operator as well as on the person using the dispenser. For the precise legal consequence in a specific place, check with the local fire authority or read the current code text directly.

Why a running engine changes the risk

Gasoline does not need to be visibly spilled to create a hazard. NIOSH lists gasoline's flash point as minus 45°F, its lower explosive limit as 1.4%, and its upper explosive limit as 7.6%. In practical terms, gasoline can produce ignitable vapor at ordinary outdoor temperatures when a suitable ignition source is present.[9]

Turning the engine off does not make a modern car electrically inert, and a running engine is not the proven cause of every pump fire. What it does is remove one avoidable source of heat and electrical activity while flammable vapor may be present at the open filler. The more frequently documented risk is behavioral: re-entering the car to wait, where sliding across the seat can build a static charge that jumps when the driver returns and touches the nozzle.

The Petroleum Equipment Institute's compilation of 176 reported static-related refueling fires recorded 87 reports in which the fueler re-entered the vehicle and then touched the nozzle. It is a voluntary incident compilation, not a measure of all fuel fires, but it supports the common safety instruction: remain outside while the pump runs; if you did get back in, touch bare metal away from the filler neck before reaching for the nozzle.[4][9]

The check-engine-light question

Many gasoline vehicles use onboard refueling vapor recovery (ORVR) as part of their evaporative-emissions system. During refueling, the system routes displaced vapor to a charcoal canister; later engine operation can purge the stored vapor into the intake. EPA describes ORVR as a nationwide program for capturing refueling emissions, and federal evaporative and refueling-emission standards apply to covered new vehicles.[10][5]

Do not treat a post-fill check-engine light as proof that the engine was left running. EVAP-monitor design and test timing vary by vehicle. Ford's service documentation, for example, says that an EVAP test that cannot pull vacuum after a refueling event can set a fuel-cap-off code, while also listing several other possible causes. A loose cap, a leaking hose, or a failed valve can produce similar warnings.[6]

Secure the cap until it clicks. If the warning remains after normal driving, read the stored code or have the vehicle diagnosed; do not rely on continued engine-on refueling as a workaround.

The narrow commercial exception does not cover passenger cars

Federal commercial rules state the baseline plainly. Under 49 CFR § 392.50, a motor carrier driver or employee may not fuel a commercial motor vehicle with the engine running, except when the engine must run in order to fuel that vehicle. That exception addresses equipment such as a vehicle-driven pumping system; it does not create permission to idle a personal car at a retail pump.[7]

OSHA applies an equally direct rule to powered industrial trucks: “Fuel tanks shall not be filled while the engine is running.” OSHA also requires spilled fuel to be washed away or fully evaporated, and the cap replaced, before the engine is restarted.[8] These are work rules, but they show the same control principle: stop the ignition source first, transfer fuel second.

What to do at the pump

  1. Park, turn the engine fully off, and follow the dispenser's posted instructions.
  2. Stay outside the vehicle while fuel is flowing. Do not use the cabin as a waiting room.
  3. Place the nozzle fully in the filler neck and stop when it automatically clicks off. Do not top off.
  4. Close the cap securely, return the nozzle, then start the vehicle.

If a fire starts, follow the posted emergency instructions. The IFC's required warning language says not to remove the nozzle and to back away immediately. Warn others, notify station staff, and call 911 when emergency help is needed.[2]

Frequently asked questions

Is it ever okay to keep the car on for air conditioning or heat?

No. Comfort does not change the engine-off instruction. Turn the vehicle off before inserting the nozzle, then restart only after fueling is complete and the cap is closed.

What if I drive a diesel vehicle?

Follow the dispenser and facility instructions. The engine-off direction in the applicable fire code applies during fueling; specialized workplace or commercial operations may be subject to additional, different rules.

Can I get a ticket?

Potentially. The precise offense and penalty depend on the adopted fire code and local enforcement. The facility also has its own compliance duty, which is why pump signage expressly tells drivers to stop the engine.
